The spirit of the original law (PD1866) was to protect the public from those who carry firearms without a license, then as Ive previously stated, the PC chief was delegated with the power to classify what were firearms. Thank you for quoting me Sir Iskwater, Just to add to my statement:

IRR protects you from being charged with PD 1866 as amended. That is a fact.

Pero you must be vigilant because there is LOI 1264, here's a worst case scenario might come in.


- You have an airsoft replica compliant with the IRR, you are accosted by the authorities.
- You present your papers.
- Unfortunately for you, in their opinion you were violating LOI 1264 because you are allegedly "public displaying your replica"
- Replica now is subject to confiscation, in accordance with LOI 1264

Question: Does the IRR since its part of PD1866 as amended, incompatible with LOI 1264, thus rendering the Letter of Instruction without force?

My opinion is, No. Since the LOI is not incompatible with the Firearms law, it is still effective & enforcable

Bottomline is: My theory is that, if authorities think you are publicly displaying your airsoft replica, you are violating the LOI, your unit is still subject to confiscation, even if you have a validly registered airsoft as prescribed with the IRR.

ei atty joe... several topics and hundreds of semantics will only give you one and only one conclusion: THAT THE IRR DOES NOT LEGALIZE AIRSOFT... correct ba sir?

I recall the comment made by the FED Chief during the dialogue with airsoft representatives. It went to the effect that they (the PNP FED) have done their part in

".. allowing airsoft to be "legally" owned and registered.. BUT.. if any incident involving airsoft ever reaches the courts, it would still be up to (us) airsofters to prove to the judge that we have not violated any firearms laws."

In my point of view the IRR doesn't legalize anything. But just provides us a loophole until such time that somebody successfully repeals the existing LOI.

NOW, THEREFORE, I, FERDINAND E. MARCOS, do hereby order and direct the following:

1. Henceforth, the importation, manufacture, distribution, sale and display of toy firearms and explosives which, even if dissimilar to in some aspects, are replicas in appearance, measurements, color and parts as its genuine counterpart firearms and explosives, are prohibited.

LOI-would define airsoft guns as toy replicas, right?
IRR - classifies airsoft as special airgun, right?

2. The Ministers of Finance, Trade and Industry, Local Government and National Defense shall issue the necessary rules and regulations to implement these instructions.

IRR - Implementing Rules and Regulations by PNP/FED, right?

3. The Philippine Constabulary/Integrated National Police is directed to confiscate all toy firearms and explosives such as described in paragraph 1 hereof, which are displayed or otherwise used for illegal or criminal purposes. Strict compliance herewith is enjoined.

Directed to confiscate IF Displayed or otherwise used for illegal or criminal purposes, right?

Just my 2 bbs for your questions sir. Technically, I would answer yes for both. It would be an irony to have something as licensed and has a permit yet illegal.

Hehe! To ALL... pls. note that most people who push for the IRR is banned from .org. The site that was link on top.

So IMHO discussions there are one sided.
